JUSTICE ARUN KUMAR ORAL ORDER 23-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bachhawara P.S.Case No. 44 of 2017 registered under Sections 8, 20(C) and 25 of the Narcotic Drugs and Psychotropic Substance Act.
Allegation in brief is that 11.50 quintals of Ganja recovered from a truck and driver and petitioner were found in it and it is said that petitioner's role was of a liner.
Submission is that this petitioner was only asked to show the house of the person to whom delivery was to be given and petitioner had boarded the truck only few kilometers before the truck was apprehended and he has clean antecedent. Having considered the aforesaid facts and circumstances and recovery of huge quantity of Ganja, the prayer of bail of the
Patna High Court Cr.Misc. No.10898 of 2018 (2) dt.23-02-2018 2/2 petitioner is presently rejected.
Trial court is directed to expedite the trial and conclude the same preferably within two years after framing of charge. If trial is not concluded within stipulated period, the petitioner may renew his prayer for bail.
