Heard Mr. Prem Prakash Poddar, learned Counsel for the writ petitioner-applicant, and Mr. Ramakant Sharma, learned Senior Counsel for the respondents-opposite party. Having considered the averments made in the application and having heard the learned counsel for the parties, we are satisfied that the absence of the applicant and/or his counsel from the Court on 29.06.2016 was for reasons beyond their control.
In view of the above and in the interest of justice, the order, dated 29.06.2016 aforementioned, is hereby set aside and
Patna High Court MJC No.2474 of 2016 (3) dt.23-08-2016 2/2 Cr.WJC No. 440 of 2016 aforementioned is hereby restored to its original file.
