JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-05-2018 The present case arises out of the impugned order dated 10.04.2018, whereby and where under the bail of the petitioner has been rejected after the petitioner was taken into custody pursuant to cancellation of his bail bond.

The learned counsel for the petitioner has submitted that the petitioner was granted regular bail in the present case in the year 1994 in connection with Bhagwanpur P.S. Case No. 35/1994 (Sessions Case No. 251 of 2004). However, his bail bond was cancelled on account of misuse of privilege of bail in as much as the petitioner had failed to appear before the concerned Court on the date fixed and in this regard there was repeated default on the part of the petitioner.

Having regard to the facts and circumstances of the case

Patna High Court Cr.Misc. No.30674 of 2018 (3) dt.30-05-2018 2/2 and the reason mentioned in the present petition, I think it fit and appropriate to direct the petitioner to deposit a sum of rupees 5000/- with the Patna High Court Legal Aid Committee within a period of four weeks from today, whereafter the petitioner may show the receipt of such deposit of rupees 5000/- and thereupon the petitioner above named shall be released on bail upon such conditions as may be imposed by the learned 5th Additional Sessions Judge, Siwan in connection with Sessions Case No. 251 of 2004 ( arising out of Bhagwanpur P.S. Case No. 35/1994). The petition is disposed of.
