The petitioner seeks bail in connection with Dinara (Bhanas) P.S. Case No. 09 of 2021 instituted for the offences under Section 394 of the Indian Penal Code. Learned counsel submits that the police after investigation submitted chargesheet under Sections 395 and 412 of the I.P.C. Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2021 and has antecedent of one case as stated in paragraph '3' of the bail application. Learned counsel for the petitioner submits that allegation is of looting the informant of his motorcycle, mobile phone, money etc. by four unknown criminals.

No.58994 of 2021(2) dt.08-03-2022 2/3 Learned counsel for the petitioner submits that the F.I.R. was against unknown and the name of this petitioner transpired in the confessional statement of Rajan Kumar. Learned counsel submits based on that the police reached the house of the petitioner from where the looted motorcycle is alleged to have been recovered. Learned counsel further submits that the petitioner had purchased the motorcycle from Rajan Kumar who had assured him that all the documents would be supplied to him after sometime but before that could happen, petitioner came to be implicated in the present case as he unknowingly had purchased a looted motorcycle.

Learned counsel submits that prior to the present case, the petitioner was a person with clean antecedent but when the police reached the police of occurrence i.e. the house of petitioner, a separate F.I.R. under the Arms Act was also instituted against him which has been mentioned in paragraph '3' of the bail application. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two

Case No. 09 of 2021 with a condition that one of the bailors shall be the father of the petitioner Nashibuddin Ansari @ Nasabudin Ansari, further if the petitioner is implicated in a case of similar nature and the same comes to the notice of the learned court below, the learned court below shall forthwith cancel his bail bonds.
