The petitioner seeks regular bail in the present case in connection with Nalanda POCSO Case No. 149/2023, arising out of Nalanda (Cyber) P.S. Case No. 50/2023, dated 05.09.2023, registered for the offence under Sections 469/ 354(C)/385/354D/504/506/507 of the Indian Penal Code and under sections 66/67/67(B) of the I.T. Acta nd u/s 12 of the POCSO Act.

As per the prosecution case, the petitioner has made a fake ID by uploading the photo and video of the sister of the informant. The person who has created the ID has been posting objectionable photo on the Instagram account. The

Patna High Court CR. MISC. No.52151 of 2024(2) dt.07-08-2024 2/2 informant asked the person to delete the account, he wanted money for the same. The petitioner had threatened the victim that he will rape the victim if the money was not given to him. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R. The petitioner has no criminal antecedent and he is in jail since 11.02.2024. Charge has been framed against the petitioner. 5.

Learned APP for the State has vehemently opposed the prayer for regular bail of the petitioner. 6.

Considering the aforesaid facts and circumstances, this Court is not inclined to grant bail to the petitioner.

This application for regular bail is dismissed. 8.

The trial court is directed to expedite the trial at the earliest.
