JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-05-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Tankuppa PS case no. 137 of 2017 instituted for the offences punishable under Sections 271, 273 of Indian Penal Code and 30(ka)(ga)(gha) of Bihar Prohibition Excise Act. The allegation is regarding recovery of 15 ltrs. of mahua liquor and 02 quintal of mahua flour from a place near the hill. It is alleged that the petitioners along with other accused persons were selling mahua liquor. It is further alleged that the petitioners herein used to sell the said mahua liquor. The learned counsel for the petitioners submits that

It is further submitted that the petitioners are having clean antecedent and they are in custody since 09.04.2018. Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya in connection with Tankuppa PS case no. 137 of 2017.
