JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-12-2021 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Vidyapatinagar P.S. Case No. 165 of 2020 registered for offence punishable under sections 363 and 366 of the Indian Penal Code.

The informant, Harendra Mahto has lodged the FIR for kidnapping of his daughter Koyal Kumari aged about 17 years.

Patna High Court CR. MISC. No.6087 of 2021(2) dt.15-12-2021 2/3 The informant came to know by the villagers that four accused persons, including the present petitioner have taken away his daughter by a "Bolero" vehicle.

The learned counsel for the petitioner has submitted that the co-accused Sanjeet Kumar Ram has been granted regular bail by the learned Additional Sessions Judge-VI-cumSpecial Court (POCSO), Samastipur, vide order dated 14.07.2021, on the basis of statement of the victim recorded under section 164 of the Cr.PC. The certified copy of the impugned order has been provided by the learned counsel for the petitioner today itself which shows that the victim, in her statement, has stated her age as 18 years and she had gone with her own sweet will and solemnized marriage with co-accused Sanjeet Kumar Ram.

Considering the facts and circumstance of the case, the petitioner above named, in the event of his arrest or surrender, within six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Samastipur in connection with Vidyapatinagar P.S. Case No. 165 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
