JUSTICE ARUN KUMAR ORAL ORDER 18-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.10.2017, seeks bail in Laukha PS Case No. 117 of 2016 registered under Sections 148, 147, 149, 341, 323, 324, 302, 307 and 504 of the IPC. The allegation in brief is that due to land dispute Umesh Yadav gave lathi blow over head of father of the informant followed by the petitioner giving iron rod blow and Jitendra Yadav is alleged to have given farsa blow on his head resulting into death of the informant's father.

Learned Counsel for the petitioner submits that two persons are said to have assaulted with hard blunt object and first assault is said to have been given by Umesh Yadav, one of the co-accused Biren Yadav and others have been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 24024 of 2017, the allegation is against three persons of assaulting over head of the deceased but only one lacerated would was found on the head of the deceased. Having considered the said facts and circumstances, the petitioner, namely, Hari Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II Jhanjharpur in connection with Laukha PS Case No. 117 of 2016.
