Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with S. Tr. No. 52/2021 arising out of ARA Nawada P.S. Case No. 424 of 2016 registered for the offence punishable under Sections 323 and 302 of the Indian Penal Code.

As per prosecution case, sister of informant was married with the petitioner ten years ago. It is alleged that petitioner assaulted the informant's sister due to which her sister died.

Learned counsel for the petitioner submits that petitioner is in custody since 17.03.2020. The petitioner is

Patna High Court CR. MISC. No.49368 of 2022(2) dt.09-12-2022 2/2 innocent and has falsely been implicated in this case merely on suspicion. Petitioner bears no criminal antecedent. Charge sheet has already been submitted in the case and there is no likelihood of tampering with the prosecution evidence. There is no independent witness to the alleged occurrence. The learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, let the petitioner above name be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureities of the like amount each to the satisfaction of learned Additional District and Sessions Judge XVIII, Bhojpur at Ara in connection with S. Tr. No. 52/2021 arising out of ARA Nawada P.S. Case No. 424 of 2016.
