2. Petitioner apprehends arrest in a case registered for the offence punishable under section 309 ( 4 ) of BNS. 3 . As per the prosecution case , on the alleged date and time of occurrence , when informant was coming from Siwan , 3 miscreants intercepted informant and on the point of pistol snatched motorcycle and bag containing ornaments of informant.

4. Learned counsel for the petitioner submitted that petitioner is not named in the F.I.R., and his name transpired during course of investigation in confessional statement of coaccused persons. No incriminating material has been recovered

Patna High Court CR. MISC. No.47884 of 2025(2) dt.05-08-2025 2/2 from the possession of this petitioner and he is in no way connected with the aforesaid occurrence .

5 . Learned counsel for the State opposed and submitted that this petitioner along with other co-accused persons, on the point of pistol, looted cash of informant.

6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U
