JUSTICE JYOTI SARAN ORAL ORDER 27-03-2017 Heard Mr. Amarendra Narayan, learned counsel for the petitioners and Mr. Lalan Kumar, A.C. to G.P.9 for the State. The petitioners inter alia seek a direction to the respondents for payment of their monthly stipend/salary which according to the petitioners, are not being paid to them.
The petitioners claim to be working as sweepers in different
Patna High Court CWJC No.12191 of 2016 (5) dt.27-03-2017 2/2 hospitals under the Bihar Primary Health Centre in the district of Darbhanga.
The grievance of the petitioners is that although they are functioning on the post but are not being paid their stipend/salary since April, 2016.
Despite three adjournments granted, the instructions are not forthcoming and Mr. Lalan Kumar, learned State counsel again prays for time for the grievance so raised.
In the nature of the claim raised and considering the delay caused by the respondents in failing to put their stand on record, I deem it proper to dispose of this writ petition with a direction to the Civil Surgeon-cum-Secretary, District Health Society, Darbhanga to consider the grievance of the petitioners and dispose it of in accordance with law preferably within a period of six weeks from the date of receipt/production of a copy of this order.
