JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-07-2016 The certified copy of the First Information Report of Karpi Police Station Case No. 46 of 2014 has been filed on behalf of the petitioners, let the same be kept on record.

Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Karpi Police Station Case No. 46 of 2014, disclosing offence under Sections 147, 149, 427, 353, 509 of the Indian Penal Code.

Learned Counsel appearing on behalf of the petitioners has, at the very outset, drawn my attention to an order of this Court, dated 30.03.2016, passed in

Patna High Court Cr.Misc. No.24993 of 2016 (3) dt.15-07-2016 2/2 Criminal Misc. No. 9798 of 2016, and has submitted that similarly circumstanced co-accused persons have been granted anticipatory bail.

Learned Counsel for the petitioners appears to be right in his submission.

This application is, accordingly, allowed.

Let the petitioners, namely, Ramadhar Singh, Ajit Kumar @ Ajit Yadav, Rahul Kumar and Anit Kumar @ Anit Paswan @ Anil Paswan, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Karpi Police Station Case No. 46 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
