JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned Advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Mehsi P.S. Case No. 283 of 2020 dated 09.09.2020 instituted for the offences under Sections 272, 273, 120(B), 34 and 30(a) of the Bihar Prohibition and Excise Act, 2018.

8109 liters of liquor is said to have been recovered from a vehicle.

The petitioner is sought to be prosecuted in this case on the basis of confession of the arrested accused person. Though the petitioner has been made accused in eight cases of similar nature but, learned counsel for the petitioner has informed this Court that because of paucity of evidence in all such cases, he has been granted bail in all of them.

The petitioner is in custody since 06.07.2021. Regard being had to the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge (Excise), East Champaran, Motihari in connection with Mehsi P.S. Case No. 283 of 2020.
