JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with S.T. No. 398 of 2017 arising out of Agiaon(G) P.S.Case No. 83 of 2017 registered under Sections 302 and 201/34 of the Indian penal Code.

Allegation in brief is that informant's father was called and taken away by three named accused persons thereafter dead body was found thrown in a field after killing him by strangulation.

Submission is that except allegation of taking away by three persons including the petitioner, there is no other material against the petitioner and there was enmity with accused persons due to dispute in previous Panchayat election and similarly situated another co-accused Raj Kumar Giri has been admitted to bail by a

Patna High Court Cr.Misc. No.8578 of 2018 (2) dt.13-02-2018 2/2 co-ordinate Bench of this Court vide order dated 06.02.2018 passed in Cr. Misc. No. 1176 of 2018; moreover petitioner has no criminal antecedent and charge sheet has been submitted. Having considered the aforesaid facts and circumstances, the petitioner, namely, Rajesh Giri, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II, Bhojpur, Arrah in connection with S.T. No. 398 of 2017 arising out of Agiaon(G) P.S.Case No. 83 of 2017.
