The petitioner who is in custody since 07.06.2019 has filed the instant application for grant of bail in connection with Benipatti P.S. Case No. 161 of 2017 (District- Madhubani) registered for the offence punishable under sections 420,403,379 and 34 of the Indian Penal Code.

As per the allegation in the FIR, the informant who had gone to withdraw money from the ATM was cheated by two persons on the pretext of assistance. It is alleged that subsequent to withdrawing money the informant received information on his mobile about debit of Rs. 1,08,000/- from his account. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown, his name

Patna High Court CR. MISC. No.47149 of 2019(3) dt.25-09-2019 2/2 transpired only on his confessional statement before the police on being arrested in another case. There is no recovery of any incriminating articles from the possession of the petitioner. The petitioner has not been put on T.I. Parade and he is in custody since 07.06.2019 The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 07.06.2019 and has not been put on T.I. Parade, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipatti in connection with Benipatti P.S.
