JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Patliputra P.S.Case No. 264 of 2017 registered under Sections 3, 4, 5, 6 and 7 of Immoral Traffic (Prevention) Act and Sections 7 and 8 of POCSO Act, 2012.

Allegation in brief is that petitioner, Manager of a hotel, was engaged in flesh trade and call girl with some clients were apprehended.

It is submitted that girl recovered from hotel in her statement recorded under Section 164 Cr.P.C., stated that one Payal was instrumental in indulging in this activity and another co-accused Neel Kamal Kumar has been admitted to bail by this Court vide order dated 12.12.2017 in Cr. Misc. No. 57603 of 2017 and petitioner is in custody since 04.08.2017 and charge sheet has

Having considered the aforesaid facts and circumstances, the petitioner, namely, Mithilesh @ Mithilesh Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the 1st Addl. District and Sessions Judge Cum Special Judge, POCSO Act, Patna in connection with Special Case No. 117 of 2017 (arising out of Patliputra P.S.Case No. 264 of 2017), with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
