Petitioners apprehend their arrest in connection with Madhuban P.S. Case No. 46 of 2019 registered for the offence under Sections 147, 148, 149, 341, 323, 332, 333, 353 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioners as per the first information report that police on the basis of secret information raided the house of Ravindra Prasad and recovered 9 liters of illicit liquor from a truck standing near the door of the Ravindra Prasad. It has further been alleged on the basis of order given by Vikash Kumar the petitioner and other accused persons pelted stones

Patna High Court CR. MISC. No.47418 of 2019(2) dt.30-07-2019 2/2 and hurled lathi-danda on the police party.

Mr. Abhishek Kumar, learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case and the name of the petitioners have been disclosed by the Chowkidar to the police. He further submits that petitioners have got no criminal antecedents and illicit liquor was recovered from near the house of one Ravindra Prasad and the petitioners have got no concern with the same. After having heard learned counsel for the petitioners and taking into consideration the fact that petitioners have got no criminal antecedents and no illicit liquor has been recovered from the house of the petitioners, as such, I am inclined to enlarge the petitioners on bail.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran, Motihari, in Madhuban P.S. Case No. 46 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
