JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 The matter was sent for enquiry to learned Registrar General, Patna High Court, Patna, for swearing false affidavit by the deponent and petitioner and suppressing the fact about criminal antecedent. Learned Registrar General has submitted the enquiry report finding deponent as well as petitioner guilty. It has been submitted on behalf of the petitioner that though the report has come that petitioner has one other criminal antecedent except the present one, however, the deponent was not aware about the fact of criminal antecedent of the petitioner and even in the case diary, there is no mention of criminal antecedent of the petitioner.

Having heard both sides, considering the fact that after enquiry, it has been found that it is a clear case of suppression of

No.9261 of 2017 (6) dt.11-05-2017 2/2 facts in a proceeding before the Court and that too by the deponent in collusion with the petitioner to get bail, as such, this application is disposed of with a warning to the deponent that if he again found engaged in this kind of act, in future, appropriate criminal proceeding will be initiate against him.
