====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-05-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 376, 504, 506 of the Indian Penal Code.

The informant, who was a married and pregnant lady, was in physical relation with the petitioner. She alleges that the petitioner forcefully established the relationship whereas the witnesses stated before the police that both were in extra marital relationship since long.

Since the informant was aware of the consequences of her consent and investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.5454 of 2021(3) dt.27-05-2021 2/2 the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Muffasil P.S. Case No. 340 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
