2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 354B, 354C, 504, 506/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act.

3. As per prosecution case, the allegation against the accused persons including the petitioner is that they tried to outrage the modesty of the informant's daughter and when she protested they took several photographs of that alleged occurrence and the same uploaded on social media.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He

As per Annexure-2, it appears that age of the victim is about 17 year and ten months. It is further submitted that the victim and the petitioner are student of same class i.e. VIII in the same school and they were in love with each other which was not acceptable to the family members of the informant and due to which the petitioner has been made accused in this case. During investigation, police has not brought any viral photographs of the victim on record. Moreover, the petitioner is languishing in judicial custody since 01.06.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
