JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-10-2021 Heard Mr. Maheshwar Prasad, the learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Rebelganj P.S. Case No. 195 of 2019 instituted for the offences under Sections 341, 323, 506, 354(A) and 34 of the Indian Penal Code.
The accusation against the petitioner nos. 2 and 3 is of having attempted to molest the informant in the wee hours when she had gone to attend to the call of nature.
Patna High Court CR. MISC. No.5096 of 2021(3) dt.25-10-2021 2/3 The learned counsel for the petitioners has submitted that an absolutely false case has been lodged because of land dispute. There is a dispute between the petitioners and the informant with respect to a plot of land which is situated in front of the house of the informant. These facts have come during the investigation of this case. One Champa Devi, who is the mother of the petitioner no. 3 and aunt of the petitioner no. 2 as well as the sister-in-law of the petitioner no. 1 has also filed a complaint case no. 2335 of 2019 against the informant and others which is pending enquiry.
Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Chhapra, Saran, in connection with Rebelganj P.S. Case No. 195 of 2019,
