JUSTICE RAKESH KUMAR ORAL ORDER 02-09-2016 Heard Sri Satyavrat Verma, learned counsel for the petitioner and Sri Bipin Kumar Sinha, learned standing counsel for the C.B.I.

The petitioner who was named as one of the accused in R.C. Case No. 04 of 2015 registered for the offence under section 120 B read with section 420, 467, 468, 471 of the Indian Penal Code and section 13 (2) read with section 13 (1)(d) of the Prevention of Corruption Act, 1988 has prayed for grant of bail in the event of arrest .

It was submitted by learned counsel for the petitioner that the petitioner has retired as Superintendent of Post from Motihari. It has also been argued that in case of one of the coaccused namely, Ram Naresh Thakur a bench of this court while

Patna High Court Cr.Misc. No.32027 of 2016 (3) dt.02-09-2016 2/2 directing for summoning case diary has directed not to take any coercive action. On the aforesaid grounds a prayer has been made for extending the privilege of anticipatory bail. It was further submitted that the petitioner had issued three appointment letters in pursuance of verification made by the Inspector of Post and as such there was no question of commission of any offence by the petitioner.

However, at the very outset, Sri Bipin Kumar Sinha, learned Standing Counsel for the C.B.I. submitted that after thorough investigation by a detailed report C.B.I. has submitted charge sheet and thereafter learned Special Judge has already passed order of cognizance on 20th February 2016. The court is of the opinion that in a case if after submission of charge sheet cognizance order is passed in normal course anticipatory bail petition may not be entertained. The petition stands dismissed.
