The petitioners seek bail in connection with Ganga Bridge P.S. Case no. 151 of 2017 registered under Section 30(A) of Bihar Prohibition and Excise Act-2016.

19.395 lts. of foreign liquor is said to have been recovered from the possession of the petitioners. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. They have no concern with the seized liquor. The petitioners have been falsely implicated in the

Patna High Court Cr.Misc. No.2286 of 2018 (2) dt.23-01-2018 2/2 case at the instance of their enemies. The petitioner no. 1 has no criminal antecedent. Though, petitioner no. 2 has one criminal antecedent as Ganga Bridge P.S. Case no. 86 of 2013 but he has been enlarged on bail in the said case. The petitioners have been languishing in custody since 9.12.2017.

Considering the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum- Special Judge (Excise Act) Vaishali at Hajipur in connection with Ganga Bridge P.S. Case no. 151 of 2017.
