Petitioner, already in custody, seeks bail in connection with Azamnagar P.S. Case No.186 of 2017, registered under Sections 302/34 of the Indian Penal Code.
Allegation in brief is that due to enmity, the petitioner and others killed the brother-in-law of the informant and the informant saw the accused persons escaping away in the midnight.
Learned counsel for the petitioner submits that the informant has said that she saw in the midnight but did not raise alarm at that time and in the morning the dead body was found but there is no eye-witness, merely due to land dispute between both sides, the petitioner has falsely been implicated moreover
Patna High Court Cr.Misc. No.8875 of 2018(2) dt.15-02-2018 2/2 charge-sheet has been submitted.
Having considered the said facts and circumstances, petitioner Jyotish Pal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Katihar in connection with Azamnagar P.S. Case No.186 of 2017.
