The petitioner seeks bail in connection with Gurua P.S. Case No. 87/2021, instituted for the offences under Section 33 of the Bihar Prohibition and Excise Act, 2016. 3160 litres of spirit is said to have been recovered from one Gautam Yadav.

The petitioner has got no connection whatsoever with the recovery or with aforesaid Gautam Yadav but he is sought to be prosecuted in this case on the basis of the statement made by the local people including the Chowkidar that the petitioner had run away from the place of raid on seeing the police party. On such statement, the petitioner was arrested after three days of the occurrence and is in custody since 13.08.2021
