Petitioner is said to have been caught while he assembled along with others for making preparation for committing dacoity but it is surprising enough that he assembled along with others without having any firearm as well as other arms because according to the prosecution case itself, only one mobile is said to have been recovered from his conscious possession.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Agiaon (G) P.S. Case no. 52/2015. shahid (Hemant Kumar Srivastava,J) U T
