This is an appeal under Section 14(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned 1st Additional Sessions Judge-cum-Special Judge (S.C./S.T.Act), Samastipur, in connection with Mohiuddin Nagar Police Station Case No.83 of 2019 registered under Section 4 of the POCSO Act, Section 376 of the Indian Penal Code and Sections 3(1)(r) (s)(w)/3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The report of the learned trial Judge would reveal that the trial is fixed for final argument.

In the past prayer for bail was refused as the appellant

Patna High Court CR. APP (SJ) No.681 of 2021(4) dt.07-04-2021 2/2 carries allegation of commission of rape against a minor girl. Learned counsel for the appellant submits that the appellant is in custody since 23.05.2019 and for last two weeks he is hospitalized.

Considering the entire facts aforesaid, I am not inclined to enlarge the appellant on bail. Hence, the prayer for bail is refused.

Accordingly, the appeal stands rejected.
