Petitioner's grievance is that his licence has been cancelled on 06.08.2002 by the District Magistrate, Bhojpur at Ara and by order dated 23.02.2007 passed by the Commissioner, Patna Division, Patna in Arms Appeal No. 102/2002, as contained in Annexure-1, the matter was remanded back to the Licensing Authority for taking a fresh decision in accordance with law.
However, even after lapse of about more than nine years such decision is pending before the Licensing Authority.
Patna High Court CWJC No.12751 of 2016 dt.28-11-2016 Accordingly, this writ petition is being disposed of with a direction to the District Magistrate-cum-Licensing Authority, Bhojpur at Ara to take a final decision in the case of the petitioner within a period of two months from the date of receipt/production of a copy of this order.
However, the District Magistrate, Bhojpur at Ara would be required to submit his explanation as to why no decision has been taken in the case for about nine years. If the same has already been taken before the present order then explanation is not required to be filed. Such explanation should be filed before the Registrar General, Patna High Court, Patna within a period of two months and the same should be placed before this Court under the heading "For Orders". Let a copy of this order be communicated to the District Magsitrate, Bhojpur at Ara.
