2. The petitioner seeks bail in connection with Jale P.S. Case No. 65 of 2025 registered for the offence punishable under Sections 105 and 3(5) of the Bharatiya Nyaya Sanhita.

3. The petitioner is a Asha worker who is said to have referred the patient to one Om Ishant Dev Hospital where the child died at the time of birth.

4. It has further come during investigation that Om Ishant Dev Hospital is being run by non-doctors. It has also come during investigation that the hospital has no facility and after the patient comes, the persons running the hospital try to get some doctor and earn their illegal money by extortion.

5. Considering the fact that the petitioner is a Government Servant and she has merely referred the patient to the aforesaid hospital, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Darbhanga in connection with Jale P.S. Case No. 65 of 2025.

7. At this stage, the District Magistrate, Darbhanga is directed to look into the matter himself so that such kind of hospitals which should be treating patients but are involved in killing the patients, do not function in the district.

8. With the aforesaid observation, this application is allowed.

9. Let a copy of this order be communicated to the District Magistrate, Darbhanga forthwith through FAX or e-mail for its compliance.
