The petitioner seeks bail in Begusarai Town P.S. Case No. 493 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

9.375 litres of foreign liquor is said to have been recovered from the plastic bag which was dumped by the petitioner on the road in front of the house of Brahmdeo Choudhary.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. He was not apprehended on the spot. Though

Patna High Court Cr.Misc. No.2453 of 2018 (2) dt.23-01-2018 2/2 Begusarai Town P.S. Case No. 140 of 2009 has been instituted against him, but he has been enlarged on bail in the said case. He has been languishing in custody since 31.10.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIIth cum Bihar Prohibition and Excise Act 2016, Begusarai in connection with Begusarai Town P.S. Case No. 493 of 2017.
