2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 302, 307, 504 and 506 of the Indian Penal Code.

3. It is a case of assaulting to the father of the informant by several accused persons including the petitioner.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. General and omnibus allegations have been levelled against the petitioners. Specific allegation is against Saurabh Kumar who has assaulted the informant's father on his head by means of axe as a result of which he died. Similarly situated other accused person has already been enlarged on bail by another coordinate

Patna High Court CR. MISC. No.50285 of 2023(2) dt.11-08-2023 2/2 Bench of this Court vide order dated22.03.2023 passed in Cr. Misc. No. 3998 of 2021. Petitioner has got no criminal antecedent and languishing in judicial custody since 29.04.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Banka in connection with Amarpur P.S. Case No. 420 of 2020.
