2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 457, 380/411 of the Indian Penal Code.

3. As per the prosecution case, FIR named persons committed the theft of arms and ammunition from the office of circle office.

4. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.50970 of 2023(2) dt.18-08-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Alauli Police Station Case No. 185 of 2023/GR No.1359 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
