The petitioner seeks regular bail in connection with Nimachandpura P.S. Case No. 74 of 2017, registered for the offence punishable under Sections 392 of the Indian Penal Code.
The allegation is regarding unknown accused persons having intercepted the informant and snatched money from him as well as had taken away the motorcycle of the informant. The learned counsel for the petitioner submits that neither any Test Identification Parade has taken place nor any recovery has been made from the possession of the petitioner and the name of the petitioner has transpired during the course of confessional statement made by the co-accused, namely, Rahul
Patna High Court CR. MISC. No.47201 of 2019(3) dt.30-09-2019 2/2 Kumar, who has already been given bail by the learned court below. It is submitted that though the petitioner is an accused in one another case, however, he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 9.5.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge VII cum ACJM, VI, Begusarai in connection with Nimachandpura P.S.
