2. Petitioner apprehends arrest in a case registered for the offence punishable under section 111 ( 4 ) and 3(5) of the BNS and sections 30 (a) of Bihar Prohibition and Excise Act. 3 . As per the prosecution case , 105.70 liters of illicit foreign liquor was recovered from seized car and one bullet motorcycle was parked near the spot.
4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the seized car from which the alleged recovered has been made . The name of petitioner transpired in the case merely because one bullet motorcycle, of which this petitioner is registered owner, was found abandoned in a different police station i. e,.
Patna High Court CR. MISC. No.47693 of 2025(2) dt.12-08-2025 2/2 Pakaribarawan Police station . No incriminating article has been recovered from conscious possession of this petitioner and he has got no concern with the alleged recovery. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts, clean antecedent of this petitioner and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Court Excise - 02, Nawada in connection with Warisaliganj P.S. case No. 273 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the BNSS 2023 .
