JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, the informant got information from the villagers that while his father was returning to his house, this petitioner and other accused persons shot him dead.

Learned counsel for the petitioner submits that the informant is not the eye witness of the occurrence. He has been implicated in this case only on suspicion. He further submits that during course of investigation only material that has come against the petitioner is that there was some serious land dispute between the parties.

Patna High Court CR. MISC. No.59662 of 2021(2) dt.08-02-2022 2/2 Petitioner is in custody since 15.1.2021. Similarly situated coaccused Dharmendra Kumar @ Baudhu has already been allowed bail by a co-ordinate bench of this Court vide Annexure 2 to the bail petition.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII Nalanda at Biharsharif in Chhabilapur Police Station Case No. 115 of 2017.
