JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2018 After some arguments, the learned counsel for the petitioner seeks to withdraw the present writ petition with liberty to file appropriate case before the court of competent civil jurisdiction for grant of succession certificate. The learned counsel for the petitioner submits that on account of availing wrong remedy, about two and half years have been wasted, hence, in case, the petitioner applies for the succession certificate, the same be expedited. Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to approach the
Patna High Court CWJC No.11457 of 2016(2) dt.28-11-2018 2/2 competent court of civil jurisdiction for obtaining a succession certificate and in case, appropriate petition is filed within a period of four weeks from today, the concerned court shall make endeavours to dispose of the same preferably within a period of six months from filing of the said petition.
