=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 19-08-2017 Heard learned counsel for the petitioner, State and the Accountant General.

2. The major grievance of the petitioner with regard to payment of all retiral dues stands redressed. However, a sum of Rs. 1,25,000/- has been withheld on account of him not having given charge of 20.682 MT of bulk bitumen.

3. Learned counsel for the petitioner submitted that though he had taken charge of the said amount of bitumen but it was useless and thus, his successor did not take charge of the same and

Patna High Court CWJC No.12852 of 2016 dt.19-08-2017 2/2 his prayer of writing off the same was duly recommended by the Executive Engineer as well as the Superintending Engineer but ultimately was not accepted.

4. After some arguments, he sought permission that he may be permitted to file an appropriate representation before the authority concerned for writing off the said amount.

5. In view thereof, the writ petition stands disposed off with liberty aforesaid.

6. If a representation is filed by the petitioner before the respondent no. 3 within three weeks from today, along with a copy of this order, the same shall be considered and disposed off on merits within the next three weeks.

7. Any payment required to be made to the petitioner in terms of the order to be passed by the respondent no. 3, shall be paid to him within four weeks thereafter. (Ahsanuddin Amanullah, J.) P. Kumar AFR/NAFR U
