JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioner No. 1 is Devar whereas; petitioner No. 2 is Gotani of the deceased and it appears that omnibus allegation of committing murder of deceased has been levelled against these petitioners. Moreover, the mother-inlaw and husband of the deceased have already been granted privilege of bail and it appears from perusal of the impugned order that none of the prosecution witness claimed to have seen the actual killing of the deceased. Furthermore, I find that one ASI inquired into the matter on the direction of Sr. Superintendent of Police and found that
Patna High Court Cr.Misc. No.36629 of 2015 (2) dt.01-09-2015 2/2 deceased had committed suicide.
Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nathnagar P.S. Case No. 136 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
