The petitioner apprehends his arrest in connection with Gaighat P.S. Case No. 135 of 2021 registered under Sections 272, 273 and 414/34 of the Indian Penal Code and Sections 30(a), 36 and 41(1) of Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has neither concern with the illicit liquor nor with the alleged vehicle. His name has been transpired by local persons due to enmity. Case No. 135 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
