ANJANA MISHRA ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.10.2017 in connection with Shahpur P.S. Case No.218 of 2017 registered for the offences under Sections 302, 201, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because there was dispute, which had occurred between the petitioner and the informant with regard to the speeding of motorcycle in the lane, that the name of the present petitioner has been taken in the F.I.R. Save and except the said allegation and a history of disputes, there is no further material in the

Patna High Court Cr.Misc. No.8200 of 2018 (3) dt.27-02-2018 2/2 case diary to implicate the petitioner and the petitioner and the father has been roped in on mere suspicion. It is further submitted that now the investigation is complete as more than three months has elapsed and, as such, the petitioner may be extended the privilege of bail.

Having considered the entire facts and circumstances of the case and that the petitioner is not having any criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Shahpur P.S. Case No.218 of 2017.
