2. The petitioner apprehends arrest in connection with Kalyanpur P.S. Case No. 284 of 2025 lodged on 15.07.2025, for the offence punishable under Sections 127(2), 115(1), 118(1), 109, 303(2), 351(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner with allegation that the petitioner along with other accused persons have reached at the residential house of the informant at about 07.30 PM with deadly weapons and started abusing. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the informant's side and the petitioner's side are agnates and land dispute is going on between them. Counsel submits that the petitioner's side has filed a criminal case against the informant's side on 16.07.2025. He submits that from the contents of the FIR, it become crystal clear that the date of occurrence is 08.07.2025, whereas, the FIR has been lodged on 15.07.2025 i.e. with delay of about seven days. He further submits that the injury report of the informant's son is annexed as Annexure-3 and as per the said injury report, it is crystal clear that the injury is simple in nature caused by hard and blunt substance. He also submits that the petitioner has four criminal antecedents and in all the cases, he is on bail. He submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that as per the pleading, it transpires that both parties are agnates, land dispute is going on between them and there is also a case and counter case filed

As such, in the present facts and circumstances of this case, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of A.C.J.M.-12, Motihari, East Champaran, in connection with Kalyanpur P.S. Case No. 284 of 2025, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
