ANSHUMAN ORAL ORDER 28-09-2022 Learned counsel for the petitioners submits that due to inadvertence name of petitioner no. 2 has wrongly been typed as 'Manoj Devi' in place of 'Manju Devi' in the bail application, therefore, he seeks permission to correct the same. Permission granted.

Learned counsel for the petitioner is directed to correct the same in course of the day.

Let the defect(s), if any, be removed within two weeks from today.

Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with

Patna High Court CR. MISC. No.59945 of 2021(3) dt.28-09-2022 2/3 Manjhi P.S. Case No. 227 of 2021 lodged under Sections 302/34 of the I.P.C.

As per the prosecution case, the allegation against present petitioners is to kill the wife of the informant, when she went for natural call.

Learned counsel for the petitioners submits that petitioner is innocent and has committed no offence. He further submits that the antecedent of the petitioners is clean and charge sheet has already been filed in this case and the petitioners are in custody since 14.07.2021.

Learned counsel for the State opposes the prayer for bail and submits that from the content of the F.I.R. as well as from the order sheet, it transpires that there was special motive for the commission of crime. The petitioners accused have taken a loan of Rs.1,82,500/- from the informant and his wife and the deceased was demanding the same from the petitioner. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail and therefore the prayer for bail petition is hereby rejected. Liberty is hereby granted to the petitioner to renew his prayer for bail after one year from the date of present rejection. The Trial Court is directed to speed the trial as earliest as

With this observation, the bail application stands rejected.
