Taking into consideration that victim has supported the accusation of rape in her statement recorded under section 164 of the Cr.P.C and she clearly stated that petitioner no. 1 committed rape on her whereas petitioern no. 2 and one another accused facilitated the petitioner no. 1 to commit rape by catching her legs, I am not inclined to grant privilege of bail to the petitioners and accordingly, their prayer for bail in connection with Mahila P.S.Case No. 06 of 2015, pending in the court of Additional District Judge 1st, Aurangabad stands rejected.
