Prayer is for grant of anticipatory bail in Sonbarsa Raj P.S. Case No. 145 of 2017 registered under sections 406, 420, 504, 506/34 IPC.

Precisely, the allegation is that the complainant advanced some amount to co-accused Lalit Biswas on the assurance that he would sell the land in favour of the complainant. An agreement was also reached. Subsequently, co-accused Lalit Biswas sold the land to the petitioner.

Learned counsel for the petitioner submits that the petitioner is a bona fide purchaser. If any fraud or cheating was played on the complainant, it was done by co-accused Lalit Biswas. The petitioner is a lady having no criminal antecedents.

Patna High Court Cr.Misc. No.3008 of 2018(2) dt.18-01-2018 2/2 Let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each, to the satisfaction of Chief Judicial Magistrate, Saharsa in Sonbarsa Raj P.S. Case No. 145 of 2017 on condition that one of the bailors of the petitioner shall be her own/close family member.
