JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-07-2019 This is an application for grant of anticipatory bail in connection with Sadar P.S. Case No. 109 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per written report, police raided the house of Dilip Chaupal and from his house 28.620 liters of Nepali Saufi liquor was recovered and the police got information that same was kept in the house of Dilip Chaupal. Thereafter, raided the house of the petitioner, but did not found anything from there. Petitioner is named in the F.I.R.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case on the basis of suspicion and nothing has been recovered from the house of petitioner and he has no criminal antecedent.
Patna High Court CR. MISC. No.45169 of 2019(2) dt.23-07-2019 2/2 Heard learned A.P.P. also, who has admitted the fact that there is no recovery from the house of the petitioner. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-Cum- Special Judge, Excise Act, Darbhanga, in connection with Sadar P.S. Case No. 109 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
