JUSTICE SUDHIR SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 302/34 of the Indian Penal Code.

Allegation against the petitioner is that as the deceased had love affairs with daughter of the petitioner and he gave threatening to the deceased, suspicion has been raised that petitioner has killed the deceased.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 13.3.2015. He has been made accused merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there any circumstantial evidence to suggest implication of the petitioner in the present case.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.43150 of 2015 (3) dt.10-11-2015 2 / 2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri A. K. Das, Judicial Magistrate, Ist Class, Nalanda at Bihar Sharif, in connection with Sare P.S. Case no. 3 of 2015.
