Petitioners apprehend their arrest in connection with Bhagwanpur P.S.Case No. 88 of 2017 registered for the offences punishable under Sections 467, 468, 471, 420 and 120B/34 of the Indian Penal Code.

Allegation against the petitioners is of obtaining job on submission of forged certificate and mark sheet. Submission of learned counsel for the petitioner is that in the website of Bihar School Examination Board the mark sheets are still exist and they are genuine and they have falsely been implicated in this case.

Heard learned counsel for the Vigilance Department. Having heard both sides and in the facts and circumstances, let the petitioners, above named, surrender in the court below within a period of four weeks from the receipt of this

Patna High Court Cr.Misc. No.10989 of 2018 (5) dt.24-04-2018 2/2 order and on their so surrendering they shall be released on provisional bail till submission of charge sheet on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S.Case No. 88 of 2017, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and they shall co-operate in investigation, otherwise their bail bonds shall be cancelled. It is made clear that once charge sheet has been submitted and case is found true against the petitioners, they should surrender and make prayer for regular bail, which shall be considered on the basis of materials available on record at that time.

With the above observation, this application is disposed of.
