Petitioner has raised a grievance that a writ of mandamus be issued to the Regional Transport Authority, Darbhanga and Secretary, Darbhanga Regional Transport Authority not to issue the permit de hors to the provisions of Section 68(3)ca) of the Motor Vehicle Act.

Petitioner is a permanent permit holder on the route Darbhanga to Kunauli via Sakari Jhanjharpuyr Phulpara vide permit no.491 of 2015 which is valid from 13.4.2015 to 12.4.2020 on Bus No.BR-7P-2105. In the meeting for grant of permit the petitioner has raised an objection that he should issue

Patna High Court CWJC No.13071 of 2016 dt.18-07-2017 the permit in terms of the order passed by this Court but ignoring the provisions of Section 68(3)(ca) of the Motor Vehicle Act but without inviting objection issuing permit. The petitioner has raised objection but has been ignored.

In such view of the matter, if any objection is pending before Regional Transport Authority, Darbhanga, he is directed to consider the same and take decision in accordance with law. With the aforesaid observation and direction this writ petition is disposed of.
