The petitioner, who is in custody, seeks bail in connection with Special Case No. 153 of 2017 arising out of Alamganj P.S. Case No. 386 of 2017 registered for the offence punishable under Sections 20/22 of the N.D.P.S. Act. Informant is the P.S.I., Sector Officer, Trafic, Patna, who in his written report has stated that on 10.10.2017 he was on duty with two constables and at about 8:30 AM he received confidential information that Ganja is being taken from Patna to Hajipur in dicky of Roshan Bus, when the bus came near Pillar No. 46 they stopped the said bus and in the presence of two witnesses dicky was opened from which 15 Kg 200 gram Ganja was recovered from the said bus.

No.2877 of 2018(3) dt.09-02-2018 2/2 Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case and it has also been submitted that petitioner is a driver of the bus and the said bus is a passenger bus in which passengers used to keep their luggage for safety and the petitioner has no concern at all with the alleged seized Ganja. It has further been submitted that co-accused namely, Santosh Thakur has already been granted bail by a Coordinate Bench of this Court vide order dated 01.02.2018 passed in Criminal Miscellaneous No. 4697 of 2018 and petitioner has no criminal antecedent and he is in custody since 11.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna, in connection with Special Case No. 153 of 2017 arising out of Alamganj P.S. Case No. 386 of 2017.
