The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 384, 386, 387, 307/34 of the Indian Penal Code.

As per prosecution case, while the informant was going to market in the meantime, the petitioner along with other co-accused person opened fire on him, which did not hit the informant and he narrowly escaped. It is further alleged that the accused person also used to demand extortion money from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is next door neighbour of the informant and a land

Patna High Court CR. MISC. No.49145 of 2022(3) dt.19-01-2023 2/2 dispute going on between both the parties as a result of which the petitioner has falsely been implicated in this present case. Nothing incriminating article has been recovered from conscious possession of the petitioner and there is no eye witness of the prosecution case. It is further submitted that the petitioner is languishing in judicial custody since 22.3.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baliya P.S. Case No. 391 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
